1.SUBJECT OF THE CONTRACT With this contract the LESSOR rents a car to the LESSEE under the following conditions: 2.DELIVERY AND RETURN OFTHE VEHICLE 2.1.The vehicle is delivered to the LESSEE in mint technical condition and good aouappearance with all the obligatory equipment required by the Road Administration Authority as well as the equipment listed in the front part of the contract form. The LESSEE undertakes to return the vehicle, the vehicle papers and the listed equipment at the agreed location and time in the same condition, in case of remarks on part of the LESSEE upon acceptance of the vehicle, the LESSEE may put those down on the front part of the contract and in the space provided for that purpose. 2.2.The non-return of the vehicle for more than 24 hours after the expiration of the contract without informint the LESSOR will be considered illegal adoption of the vehicle and the LESSOR will therefore inform the authorities (the Ministry of Internal Affairs and the Insurer). The LESSOR may also declare the vehicle and the LESSEE for national search, preserving all rights under the contract. 2.3.The delay in the return of the vehicle is paid according to the tariff. 3.DAMAGES AND MISSING BENEFITS 3.1.Damages inflicted to the vehicle as a result of improper use - under the effect of alcohol, drugs, motor-races etc./ are fully compensated for by the LESSEE, 3.2.Damages inflicted to the vehicle by the LESSEE for which official documents by the Rose Administration Authority have not been supplied, are fully compensated for by the LESSEE. 3.3.The LESSEE bears the whole responsibility for damage guiltily inflicted to third parties and is bound to pay the amount of the civil! liability indemnity fixed by the Insurance company within the defined period if the regressive claim of the Insurer has been granted according to Art. 19 of the Act on Obligatory Insurance. 3.4.In case of loss, destruction or theft of the vehicle papers or registration number plates, the LESSEE is to pay a penalty amounting to their cost plus the rental price of the vehicle for one day as missed benefit because of the impossibility to the vehicle untili the registration plates and the papers of the vehicle are recovered. 3.5.In case of loss, destruction or theft of the key the LESSEE is to pay a penalty equal to the size of its cost. 3.6.In case of damages inflicted to the car by the LESSEE, which required prolonged stay of the vehicle for repair, the LESSOR may require up to 100% of the rental rate for that period as missed benefit. 3.7.Expenses for road assistance and repairs or improvements without the knowledge of the LESSOR are not compensated for. 4.RATES AND DEPOSIT 4.1.The rental rate of vehicle is fixed according to the rent period and in terms of the tariff, which is part of the contract. It is paid upon the reception of the vehicle. 4.2.The LESSEE undertakes to pay the deposit according to the tariff upon signing the contract. 4.3.The deposit is only guarantee for the vehicle and may not be used for paying in case of prolonging the contract. The deposit is released upon the return of the vehicle and after the vehicle has been inspected in accordance with the data filled in the front part of the contract. 4.4.In case of damages inflicted for which the LESSEE submits an official report by the , Road Administration Authorities the deposit is kept by the LESSOR until the indemnity is payd by the Insurer. 4.5.In case of damages done for which the LESSEE does not submit a report by the Road Administration Authorities, the cost of the damage is deducted from the deposit, 4.6.When the cost of the damage is greater than the amount of the deposit and the LESSEE has not submitted the official report by the Road Administration or Police Authorities, the LESSOR is entitled to claim for full compensation of the damage. 5.LIABILITY OF LESSOR 5.1.The LESSOR is responsible for damages caused to the LESSEE or to third parties as a result of technical faults of the vehicle, encountered by impartial technical expertise. The expenses for conductiong the expertise are fully compensated for within 24 hours. 5.2.In case the rented vehicle does not perform as required due to technical defects, the LESSOR is obliged to replace it at the LESSOR'S expense withi 24 hours. 6.LIABILITY AND OBLIGATIONS OF THE LESSEE 6.1.The LESSEE is obliged: A)To use the vehicle properly and maintain it with the care of a good husband; B)In case of accident, damage or defect to undertake all necessary measures as to prevent continue and/or lessen the damage to the rented vehicle. C)In case of accident or damage to the vehicle other than insignificant incidents, to abide to the requirements of the LAW 'or Road Transportation and the corresponding Regulation Act concerning the insurance of the relevant documents by the Road Administration Authorities. Within 24 hours from the time of the incident but no later than the time of expiry of the contract the LESSE is obliged to inform the LESSOR of all the facts, circumstances and data (names of witnesses etc.) concerning the incident as well as assure full assistance to the LESSOR and the Insurer in order to clear the facts of the incident and the damage inflicted. 6.2.The LESSEE has no right: A)to use the vehicle for hauling other vehicles or trailers or take part in races, trainings or tests, to transport bulk loads etc, B)to drive the vehicle under the effect of alcohol, drugs etc. C)to let another person drive the vehicle or use it for travels abroad. 6.3.The LESSEE must possess a legal driving license and over 3 years of experience. 6.4.In case of breaking the clauses of 5.1. - 5.3. which has resulted in damage to the vehicle, the LESSOR will be entitled for full compensation. 6.5.The LESSEE agrees that the LESSEE'S personal data, filled in the contract is used in persecution for criminal and civil liability. In case of technical problems, accidents or thefts please call us at tel.: 089 841 59 76; 088 412 41 70 Expenses made for small accidental technical services, caused as a result of company faults and for which the company gave its expressive consent, are cashed only after the client provides an official receipt. In case of accident or theft seek the assistance of the authorities and ask for issuance of the relevant documents Useful and emergency numbers: Emergency: 112 Police: 166 Traffic police: 165 Medical Emergency: 150 Client's observations when accepting the car: The car equipment: spare type, jack and key, firstaid kit, triangle, fire extinguisher, reflector, alarm, stereo. 1.The client is fully responsible for all car da¬ mages and breakdowns, caused by inappropriate speed or inappropriate use of the vehicle, as well as financially responsible for damages on the tires, wheels or wheel rims. 2.Delay in car return between one and three hours are charged an extra 1/2 rental rate. Delay over three hours are charged a full rental rate. Delay of more than 24 hours without warning the company or without its expressive consent, are charged as follows: the rental price for the extra days + one rental day fee, and the car is reported missing to the police and the insurance agency. 3.The non-returned amount of gasoline shall be deducted from the deposit or shall be paid in cash by the client. Extra gasoline is not refunded by the company. 4.All services, within or out of the working hours, are paid according to the attached price-list 5.In cases of car return before the contract has expired, an extra day is charged from the amount due.
